Boating Under The Influence, or BUI, is an offense that few people consider when planning their recreation on the water. Under Florida Law, many of the same rules apply to people operating boats as to those on the public roadways.
What should people consider about BUI when operating a boat in Florida? Law Enforcement may generally use "safety" as a reason to board your boat. So the same standards that apply to the roadways for a traffic stop do not apply for a boating safety check. Trying to evade law enforcement on the water once lights and/or sirens are engaged is typically futile. Stop and be polite!
If accused of BUI, the same Blood Alcohol Limits that are used for DUI apply. However, refusing a blood alcohol test when accused of BUI does not carry the same criminal penalties as DUI. Refusal to submit to blood alcohol tests in BUI's can result in a fine of $500 with no suspension of your Florida Driver's License.
